W-9, 1099-NEC and a Contractor Agreement: Which Does What?
A W-9 gathers tax information, a 1099-NEC reports certain payments, and a contractor agreement sets the work terms. Buying or signing a contract does not complete the tax paperwork. Use separate steps so the right information goes to the right place.
- Form W-9
- Provides the taxpayer’s identification and certification to the requester. It does not describe your project or negotiate a price.
- Form 1099-NEC
- Reports applicable nonemployee payments. It does not create the work agreement.
- Contractor agreement
- Records the parties’ work, payment and other agreed terms. It does not file a tax return or guarantee contractor classification.
1. Collect tax details through a secure process
The IRS Form W-9 page explains its tax-identification purpose and provides the official form. Keep completed tax forms in your secure accounting records. Avoid putting a taxpayer identification number into a project description, public message or contract-builder text field.
A practical onboarding checklist can track “tax information received” without copying the sensitive number into every project record. Agree with your bookkeeper who collects the form and who is permitted to access it.
2. Record the work terms in the agreement
The work agreement should reflect the actual arrangement: who is doing the work, deliverables, payment, expenses and how the engagement ends. Our contractor agreement checklist helps organize those decisions. Keep signed contracts and later approved changes with the project records.
A hypothetical design project illustrates the separation: the agreement describes the design work and price; the accounting process holds tax details; the payment ledger records what was actually paid during the year. A signed $3,000 project agreement is not itself proof that $3,000 was paid in that year.
3. Check reporting rules for the payment year
2026 update: the general federal Form 1099-NEC threshold for reportable nonemployee services is $2,000 for payments made in 2026; payments made in 2025 used $600. Inflation adjustments may apply beginning in 2027. Exceptions apply, including backup withholding regardless of payment amount. Card and third-party-network payments have separate reporting rules. Use the current IRS 1099-MISC and 1099-NEC instructions for the payment type, recipient and tax year; do not apply this headline threshold to every information return.
Ask your tax preparer to reconcile the ledger, payment methods, tax classification and any state requirements. Wi Filings’ agreement product does not include tax-return preparation or information-return filing. Do not use absence of a 1099 as a worker-status or tax-exemption determination.
Keep classification as its own decision
The IRS looks at the actual relationship, not just the label on a form. Read IRS worker-classification guidance for the federal tax framework. A W-9, a contract and a 1099 can document different parts of a relationship; collecting all three does not automatically make the classification correct.
Common questions
Does buying this agreement file a 1099 for me?
No. The document purchase does not prepare or file a W-9, 1099-NEC or other tax return. Tax reporting is a separate task for your business or tax preparer.
Does the reporting threshold decide whether I need an agreement?
No. A tax-reporting threshold does not set the amount at which a written work agreement becomes useful. Scope, payment and delivery expectations can matter on a small project too.
Should I enter a Social Security number in the agreement builder?
No. Keep tax-identification information in your secure tax-record process. It is not needed to describe the project or choose contract terms in this builder.
